The petitioners apprehends their arrest in a case registered for the offence punishable under Sections 364A/34 of the Indian Penal Code.

As per the FIR, the petitioners are said to have kidnapped the informant with an intention of demand for ransom. When the family members of the informant went to the place of occurrence, the petitioners escaped from there. 4.

It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have committed no offence. They have been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. There is no specific overt act against the petitioners. The

No.74317 of 2024(2) dt.10-01-2025 2/2 occurrence took place on 11.09.2023 and the FIR Was lodged on 13.09.2023 i.e. after delay of two days, without giving any plausible explanation regarding the said delay. It is further submitted that similarly situated co-accused has been granted bail by this Court vide order dated 18.04.2024 passed in Cr. Misc. No.12862 of 2024. Petitioner no.1 has one criminal antecedent and petitioner no.2 has no criminal antecedent. 5.

Learned APP for the State opposed the prayer for anticipatory bail.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Laxmipur (Gidhour) P.S. Case No.415 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
