The petitioner being the husband of the victim is apprehending his arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.

The prosecution case is of killing the daughter of the informant, Pushpa Devi after six years of the marriage for non-fulfillment of the dowry demand. It is submitted by learned counsel for the petitioner that on conclusion of the investigation the petitioner was not sent up for trial as it was found that the victim died since she was suffering from Brain Malariya, but differing with the

Considering the fact that the accusation was not found true during investigation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur (Phullidumar) P.S. Case No. 124 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
