ANJANA MISHRA ORAL ORDER 24-09-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are in custody since 03.07.2019 in connection with Beldaur P.S. Case No.126 of 2019 registered for the offence under Sections 30(a) and 32(c) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioners submits that Petitioner No.1 is the Driver and Petitioner No.2 is co-passenger coming from Saharsa and the alleged recoveries of liquor were not from the conscious possession of the petitioners. The petitioners are also not having any criminal antecedents. Considering the aforementioned facts and
