The petitioner seeks bail in a case registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 16.07.2021, charge-sheet has been submitted and is a person with antecedent of one case. The informant alleges that the petitioner alongwith two other accused was trying to commit theft of his motorcycle but the petitioner was caught and disclosed the names of the accused who fled away as Vijay and Mukesh.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. He

Patna High Court CR. MISC. No.861 of 2022(2) dt.23-05-2022 2/2 was merely standing near the motorcycle and the informant thought that the petitioner was trying to steal the motorcycle. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 16.07.2021 and charge-sheet has been submitted, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Punaura P.S. Case No. 114 of 2021.
