Petitioner is languishing in judicial custody since 14.04.2017 in connection with Jogapatti P.S. Case No. 113 of 2017 for offences punishable under Sections 452, 341, 323, 354, 420 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that while he was returning to his house he came across the petitioner, who introduced himself as a relative and was taken to the informant's house where he starting misbehaving with his 13 year old daughter. Thereafter petitioner was beaten by the informant and other family members and handed over to the police.

No.30411 of 2017 (5) dt.05-09-2017 2/2 It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and has been falsely implicated in the aforesaid case. He submits that no offence under Sections 452, 454, 420 of the Indian Penal Code is made out and the allegations are vague. He further submits that charge-sheet has already been submitted and there is no allegation of tampering of the prosecution witnesses by the petitioner. However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Addl. Sessions Judge, West Champaran, Bettiah, in connection with Jogapatti P.S. Case No. 113 of 2017.
