JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 This is an application for grant of anticipatory bail in connection with Nardiganj (Nawada) P. S. Case No. 17 of 2016, disclosing offences under Sections 420 and 406 of IPC. As per the F.I.R. investigation was going on with respect to appointment of the Panchayat Teacher and the persons concerned were directed to submit the folder with respect to appointment of Panchayat Teachers and petitioner happens to be the Mukhiya of the Gram Panchayat.

Submission of the learned counsel for the petitioner is that a direction was given to the Panchayat Secretary for depositing the folder but the petitioner is Mukhia and considering the same, one of the accused person has been granted bail, vide order dated 11.06.2019 passed in Criminal Misc. No. 36455 of 2019.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Judicial Magistrate, 1st Class, Nawada, in connection with Nardiganj (Nawada) P. S. Case No. 17 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that she has to co-operate the authority concerned and the Investigating Officer.
