JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-07-2017 This application is for grant of bail in connection with Buxar (Town) P.S. Case No. 193 of 2017 registered for the offences punishable under sections 397 and 411 of the Indian Penal Code.
Allegation against the petitioner is that he was arrested while committing theft of motor cycle. Submission of the learned counsel for the petitioner is that though it is alleged that he has been arrested at the Railway Station but the case has been lodged at Buxar (Town) Police Station. Further submission is that the petitioner is in custody for three months and he has two more cases but he is on bail in these cases.
Heard learned Additional Public Prosecutor also.
Patna High Court Cr.Misc. No.32165 of 2017 (3) dt.19-07-2017 2/2 Having heard both sides and in view of the facts and circumstance and nature of allegation, I am not inclined to grant bail to the petitioner. However the Trial Court is directed to expedite the trial and conclude the same within a period of five months from the date of receipt or production of a copy of this order. If the trial is not concluded by the aforesaid period, the petitioner will have liberty to renew his prayer for bail. With the above observation and direction, this application is dismissed.
