At the outset, learned counsel for the petitioner has submitted that the petitioner has one criminal antecedent but inadvertently and mistakenly, it has been left to be mentioned in para 3 of bail petition.

Heard learned counsel for the petitioner and the learned APP for the State.

This is an application for regular bail on behalf of the petitioner for the offence alleged under sections 272, 273 of the Indian Penal Code and section 30(a) of Bihar Prohibition of Excise Amendment Act, 2018.

As per allegation, 05 liters of country made liquor was

Patna High Court CR. MISC. No.809 of 2022(2) dt.31-05-2022 2/2 recovered from the possession of the petitioner. Learned counsel for the petitioner has submitted that the petitioner is in custody since 22.11.2021.

Considering the period of custody of the petitioner, let the petitioner above named be released on bail only after verifying criminal antecedents of the petitioner on furnishing bail bond of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge II, Jamui in connection with Chandradeep P.S. Case no. 149 of 2021.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) s.hassan/- U T
