====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-07-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Banka P.S. Case No. 231 of 2017, registered for the offence punishable under Sections 25(1-B)a, 26 of the Arms Act. The allegation levelled by the informant i.e. the Officer-in-charge, Banka Police Station is that while he was on patrolling duty, he had found two persons sitting at the ridge and upon seeing the police personnel, they tried to flee away, but both were apprehended by the police and on search, 12 bore country made gun loaded with 12 bore live cartridges were recovered from the petitioner.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated, he has no criminal

Patna High Court Cr.Misc. No.30770 of 2017 (2) dt.06-07-2017 2/2 antecedent and is in custody since 1.5.2017.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail immediately upon completion of six months from the date of his custody.

Accordingly, the learned trial court is directed to enlarge the above named petitioner on regular bail just upon completion of six month of his custody i.e. from 1.5.2017 on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 231 of 2017.
