Petitioner is apprehending his arrest in a case registered under sections 406, 409, 420 of the Indian Penal Code. Learned counsel for the petitioner submits that Rs. 80, 88, 855.36/- is alleged to have been misappropriated by the petitioner. The petitioner in pursuance of the order dated 09.05.2014 passed by this court has already deposited, 5, 50000/- . Learned counsel further submits that in view of the general order passed by this court the petitioner is ready to deposit 20% of the amount misappropriated and the amount deposited by him earlier may be included in the amount so calculated.

Patna High Court Cr.Misc. No.34596 of 2015 (2) dt.20-08-2015 2/2 Learned counsel for the B.S.F.C. submits that if such an amount is deposited by the petitioner within eight months, the amount already deposited shall be deducted while calculating 20% of the amount.

Considering the submission of both sides let the above named petitioner in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in Laheriasarai P.S. Case No. 163 of 2015, subject to the conditions laid down under section 438(2) Cr.P.C.
