ANJANA MISHRA ORAL ORDER 01-12-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State assisted by the learned counsel for the informant.

Petitioners being father-in-law and mother-in-law are apprehending their arrest in Kadirganj P.S. Case No. 105 of 2014 for the offence under Sections 304(B), 328 and 20B/34 of I.P.C.

Learned counsel for the petitioners submits that the present case against these petitioners has been initiated after lapse of a year and an after thought. So far as the petitioners are concerned, they have been residing at Patna where Petitioner No.1 is a vegetable vendor and Petitioner No.2 is his wife. The deceased had, in fact, died at the village home and the petitioners are residing in Patna.

No.34099 of 2015 (3) dt.01-12-2015 2/2 Considering the nature of allegation made in the First Information Report against the petitioners, let the petitioners, abovenamed, in the event of their arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the Sri B.K.Singh, J.M. 1st Class, Masaurhi, District- Patna, in Kadirganj P.S. Case No. 105 of 2014 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
