JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-05-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 342, 323, 324, 307, 506, 504, 34 of the Indian Penal Code. The prosecution case is that on 27.03.2016 at 11:30 P.M when the informant was sleeping the accused persons including the petitioners came variously armed and assaulted on the head of the informant.
It is submitted by learned counsel for the petitioners that with regard to some of the injuries the opinion has been kept reserved but other injuries have been found to be simple. There is counter version of the occurrence also. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the
Patna High Court Cr.Misc. No.23974 of 2016 (2) dt.30-05-2016 2/2 petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on provisional anticipatory bail for three months on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Lakhisarai in connection with Piri Bazar P.S. Case No. 27 of 2016, G.R. No. 424 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
Let learned Court below verify from the records, if no one has received grievous injury then provisional bail of the petitioners will be confirmed by learned Court below.
