2. The petitioner apprehends his arrest in connection with Jandaha (Mahisaur) P.S. Case No. 164 of 2025 dated 19.04.2025 registered under Section 30(a) of the Bihar Prohibition and Excise Amendment Act.

3. As per the first information report, on a secret information of transportation of liquor, a police team was checking the vehicles and on seeing the police party, one motorcycle took u-turn and tried to escape and on chase the motorcyclist flee away leaving behind the motorcycle, from which 20 liters of country made liquor was recovered and the motorcycle and the liquor were seized.

4. Learned counsel for the petitioner submits that neither the seized article nor the motorcycle, from which country made liquor is said to have been seized, belongs to the

Patna High Court CR. MISC. No.66018 of 2025(2) dt.24-09-2025 2/2 petitioner, who has no criminal antecedents. The name of the petitioner has surfaced in this case on the statement of Mahal Chaukidar, who is said to have identified the fleeing person to be the petitioner.

6. In view of the fact that the petitioner has no criminal antecedents and he has not been apprehended with the illicit liquor, I am inclined to grant anticipatory bail to the petitioner.

7. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.I-cum-Additional District & Sessions Judge, Vaishali at Hajipur, in connection with Jandaha (Mahisaur) P.S. Case No. 164 of 2025 subject to the condition as laid down under Section 482 (2) of the B.N.S.S., 2023.
