JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in a case registered under Section 379 of the Indian Penal Code.

As per prosecution case T.V, Stabilizer and other electric articles worth Rs. 3,00,000/- were stolen from the shop of the informant.

It is submitted by the learned counsel for the petitioner that the petitioner has committed no offence. No incriminating article has been recovered from the conscious possession petitioner. There is nothing on the record indicting the complicity of the petitioner in the occurrence, except confessional statement of co-accused, namely, Sunil Kumar Yadav. The petitioner is in custody since 16.05.2017.He has no criminal antecedent.
