The Petitioners are apprehending their arrest in Shahpur P.S. Case No. 365 of 2015 registered for the offence punishable under Sections 147, 148, 149, 332, 333, 337, 353, 427, 435 of the Indian Penal Code.

It is alleged that the petitioners who are said to be members of unlawful assembly have prevented the police from discharging their duties on account of death of two persons who are said to have been killed by a running truck. Further it is alleged that they have assaulted the police personnel with lathi and danda. Moreover, as a matter of fact altogether 21 persons

Patna High Court Cr.Misc. No.32062 of 2017 (2) dt.13-07-2017 2/2 and 150-160 unknown persons have been named in the F.I.R. but no specific allegation has been leveled against these petitioners, who are of clean antecedent.

Considering the aforesaid facts and circumstances of the case, let the petitioners named above in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Shahpur P.S. Case No. 365 of 2015; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
