JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 372/511, 506 and 379/34 of the Indian Penal Code.
It is alleged that the petitioner made attempt to ravish the informant, subsequently the informant went to the house of the petitioner to make complaint then the mother of the petitioner came and made assault and also snatched jewellery. It is submitted by learned counsel for the petitioner that for the occurrence of 15.07.2014, the FIR was registered on 05.09.2014. The informant was never put to medical examination, statement to that effect has been made in para 3 of the supplementary affidavit. A statement has been made in para 9 of
Patna High Court Cr.Misc. No.33860 of 2015 (2) dt.08-09-2015 2/2 the petition that after conclusion of the investigation, final form was submitted under Sections 323, 341, 354 and 504 of the IPC. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
Considering the delayed lodging of the case and the fact that the informant was never put to medical examination, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Jhanjharpur, Madhubani in connection with Jhanjharpur (Araria Sangram) P.S. Case No. 176 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
