The petitioner is languishing in custody in connection with Jokihat (Mahalgaon) P.S. Case No. 134 of 2015 for the offence instituted under Section 304B/34 of the Indian Penal Code.

There is allegation against the petitioner is that he along with others have committed murder of his daughter-in-law due to non-fulfillment of the demand of dowry. It has been submitted on behalf of the petitioner that petitioner is in custody since 01.04.2016. Charge sheet has been submitted in the present case and there is no criminal antecedent against the petitioner. There is no allegation of tampering of the

Patna High Court Cr.Misc. No.23671 of 2016 (4) dt.05-08-2016 2/2 witnesses against the petitioner. Petitioner is said to be the fatherin-law of the deceased. He has separate mess and property from the husband of the deceased. The husband of the deceased is in custody.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Jokihat (Mahalgaon) P.S. Case No. 134 of 2015.
