Petitioner seeks bail in NDPS Case No.47 of 2017 arising out of Adapur (Harpur) P.S. Case No.126 of 2017 instituted for the offence under Section(s) 20, 22, 23 and 24 of the Narcotic Drugs and Psychotropic Substance Act pending in the Court of the Sessions Judge/Special Judge, East Champaran at Motihari.
It is alleged in the written report that on confidential information the police apprehended this petitioner along with one Ramesh Prasad Yadav and recovered 250 Grams Brown Sugar from possession of one of the persons in presence of independent
Patna High Court Cr.Misc. No.31997 of 2017 (4) dt.24-08-2017 2/2 witnesses.
Case diary was called for.
The learned APP has pointed out that the informant in his further statement and other witnesses in para 16, 17, 18, and 19 have all stated that the aforesaid Brown Sugar has been recovered from the possession of this petitioner. In such circumstances, this Court does not find it a fit case for grant of bail.
Accordingly, prayer of the petitioner for grant of bail is rejected at this stage.
The Trial Court is directed to expedite the trial. (Sanjay Priya, J) JA/- U T
