JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 14-07-2017 Heard learned counsel for the petitioner, learned counsel for O.P. No. 2 and learned A.P.P. for the State. Supplementary affidavit has been filed on behalf of the petitioner annexing a copy of the order dated 16.05.2017 and copy of compromise petition filed on behalf of both the parties. It is submitted on behalf of the learned counsel for the O.P. No. 2 that the dispute between the parties has been settled amicably and now there is no dispute between them and, as such, this Criminal Miscellaneous should be allowed and quashed the order dated 14.01.2013 passed by learned S.D.J.M., Patna City in Complaint Case No. 856 of 2012.
Patna High Court Cr.Misc. No.48893 of 2013 (7) dt.14-07-2017 The petitioner is the land lord and the O.P. No. 2 was his tenant and he has already vacated his suit premises and further all the disputes between the parties have been settled amicably.
Under the circumstances, considering the compromise arrived between the parties, the order dated 14.01.2013 passed by the learned S.D.J.M., Patna City in Complaint Case No. 856 of 2012, is hereby quashed, subsequently the entire criminal proceeding stands quashed.
In the result, this criminal miscellaneous is hereby allowed.
