The petitioner seeks bail in Lakhisarai P.S. Case No. 248/2014 corresponding to Sessions Trial No. 10/15, registered for the offences punishable under Sections 302, 34 of the Indian Penal Code and section 27 of the Arms Act.
The prayer for bail of the petitioner was earlier rejected vide order dated 28.04.2015. This is the fourth attempt. Lastly, the prayer for bail of the petitioner was rejected on 22.03.2017, vide order passed in Cr. Misc. 3825/2017. Learned counsel for the petitioner submits that the trial has not yet been concluded, but from perusal of the report called from the Additional Sessions Judge Ist, Lakhisarai, it appears that the prosecution witnesses as well as the defense
Patna High Court Cr.Misc. No.33097 of 2017 (3) dt.16-08-2017 2/2 witnesses have already been examined. The argument is going on. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
