Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 325, 307, 504 and 506/34 of the Indian Penal Code.
Learned Senior Counsel for the petitioner submits that the petitioner is in custody since 07.09.2021, charge-sheet has been submitted and is a person with clean antecedent. The informant alleges that his son along with his son and daughter had gone on his motorcycle for a ride around their agricultural field and when they reached at the place of occurrence, it is alleged that Subodh Singh was sitting in his

No.826 of 2022(2) dt.23-05-2022 2/3 mill shop whereas petitioner along with co-accused Rana Pratap @ Bhaggu hit the son of the informant with a sharp edge weapon due to which he sustained injury on his neck. It is alleged that Subodh Singh hit on the leg of the informant's grand daughter by lathi with an intention to kill on account of which her leg got fractured. It is alleged that on hearing Halla, the informant reached the place of occurrence and took the victim to the hospital.
Learned Senior Counsel for the petitioner submits that the petitioner has been falsely implicated in the present case on account of land dispute and even presuming what has been alleged is true without admitting for the purposes of bail then the allegation of assault is not repeated and the nature of injury though on the vital part of the body is found to be simple in nature and petitioner is a person with clean antecedent. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody since 07.09.2021, charge-sheet has been submitted and is a person with clean antecedent and injury is simple in nature, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand)
Patna High Court CR. MISC. No.826 of 2022(2) dt.23-05-2022 3/3 with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sarsi P.S. Case No. 08 of 2021.
