ANJANA MISHRA ORAL ORDER 21-08-2015 Heard learned counsel for the petitioners and the learned counsel for the State.
The petitioners are apprehending their arrest in a case registered for the offences under Sections 341, 323, 504, 427, 337, 338 and 307/34 of the Indian Penal Code. Learned counsel for the petitioners submits that there is case and counter case between the parties and the dispute arose out of sudden provocation regarding construction of boundary wall and in the said altercation, both the parties received serious injuries.
Considering the nature of allegations made and that the occurrence took place on the spur of the moment and also that the

No.33158 of 2015 (2) dt.21-08-2015 2/2 petitioners have no criminal antecedents, let all the petitioners, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sherghati, District-Gaya, in connection with Maigra P.S. Case No.10 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
