2. The petitioner seeks bail in connection with Chauri P.S. Case No. 123 of 2025 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, there is recovery of 150 litres of country made liquor.

4. Learned counsel for the petitioner submits that the petitioner has not been caught on the spot. He further submits that the petitioner is in custody since 01.08.2025 and claims clean antecedent.

5. Learned APP appearing for the State opposes the prayer for bail of the petitioner.

6. Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.61787 of 2025(2) dt.22-09-2025 2/2 and submissions of learned counsel for the petitioner, let the petitioner, above named, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court-1, Bhojpur, Ara /concerned Court below in connection with Chauri P.S. Case No. 123 of 2025.

7. At the time of accepting bail bonds of the petitioner, the Court below will verify the criminal antecedent of the petitioner. If it is found that the petitioner has criminal antecedent, the Court below shall not accept the bail bonds of the petitioner and if it is found that the petitioner has clean antecedent, his bail bonds shall be accepted by the Court below.
