JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 306 of the Indian Penal Code. Originally, petitioner lodged the present case i.e. Pipra P.S. Case No. 46 of 2003 against one Satyanarayan Sharma. The petitioner made allegation against the accused of the aforesaid case that Satyanarayan Sharma had established illicit relation with his wife and subsequently, gave some poisonous substance to her, who ate the aforesaid poisonous substance, as a result whereof, she died.
In course of investigation, witnesses claimed that it was the petitioner, who gave poisonous substance to his wife and
Patna High Court Cr.Misc. No.25528 of 2016 (3) dt.05-07-2016 2/2 accordingly, the petitioner was made accused and the present case was converted under section 306 of the Indian Penal Code. The charge sheet was submitted against the petitioner, sometime in the year 2011, showing the petitioner absconder and subsequently, he was apprehended and remanded in this case on 10.11.2015, and since then, he is languishing in jail custody. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Supaul in connection with S.Tr. No. 37 of 2016 arising out of Pipra P.S. Case No. 46 of 2003.
