The petitioner seeks bail in Chousa P.S. Case No. 230 of 2016 registered under Sections 147, 148, 149, 341, 323, 385, 386, 387, 379, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner along with other fifteen accused persons are said to have demanded extortion of Rs. 1 lac from the informant and resorted firing at the house of the informant over not coughing up the demand and also slapped the informant and snatched Rs. 20,000/- from him.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case due to
Patna High Court Cr.Misc. No.31035 of 2017 (2) dt.06-07-2017 2/2 land dispute and for which, a proceeding under Section 144 Cr.P.C. has been initiated against both the parties vide Misc. Case No. 41 of 2017. He has never demanded any ransom from the informant. No one has sustained any fire arm injury. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The petitioner has been languishing in custody since 14.04.2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., UdaKishunganj, Madhepura in connection with Chousa P.S. Case No. 230 of 2016.
