1. Heard learned counsel for the petitioners and learned APP for the State.

2. The learned counsel for the petitioners, at the outset, seeks permission to withdraw the anticipatory bail application with respect to petitioner no. 1, Dhamanti Devi @ Dhanmanti Devi who was arrested during pendency of the anticipatory bail application.

3. Permission is accorded.

4. Accordingly, the present anticipatory bail application is dismissed as withdrawn with respect to petitioner no. 1 only.

5. The petitioner no. 2 apprehends her arrest in a case

Patna High Court CR. MISC. No.68017 of 2024(2) dt.12-02-2025 2/3 registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 337, 325, 307, 332, 333, 353, 427, 504 and 506 of the Indian Penal Code read with Sections 3/4 of Prevention of Damage of Public Property Act, 1984.

6. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is a woman. It is next submitted that similarly situated co-accused Sunny Kumar along with three others had approached this Court seeking anticipatory bail by filing Criminal Miscellaneous No. 64121 of 2024 and the same was allowed by an order dated 10.02.2025. It is next submitted that case of the petitioner is similar to the case of Sunny Kumar and others and thus seeks anticipatory bail based on parity.

7. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

8. Considering the submissions made by the learned counsel for the petitioner, the petitioner no. 2 above-named, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case

Patna High Court CR. MISC. No.68017 of 2024(2) dt.12-02-2025 3/3 is pending/successor court in connection with Madhuban P.S. Case No. 42 of 2024 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
