The present application has been filed seeking restoration of Cr. Misc. No. 17582 of 2013 which was dismissed due to non-appearance of the learned counsel for the petitioner on 02.07.2015.
Learned counsel for the petitioner submits that due to personal reasons, he could not appear in time resulting in the case being dismissed.
Patna High Court Cr.Misc. No.34721 of 2015 (3) dt.23-09-2015 2/2 Learned A.P.P. does not oppose.
For the reasons mentioned in the application and considering the submissions of learned counsel for the parties, the order dated 02.07.2015 passed in Cr. Misc. No. 17582 of 2013 stands recalled.
