ANJANA MISHRA ORAL ORDER 27-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 05.08.2019 in connection with Vikbhutipur P.S. Case No. 183 of 2019, registered for the offence under Sections 272 and 273 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner, but from Sumit Bricks Chimani Bhatha and in which the petitioner is a Munshi. The petitioner has got no criminal antecedent.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on

Patna High Court CR. MISC. No.58511 of 2019(3) dt.27-09-2019 2/2 bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Samastipur in connection with Vibhutipur P.S. Case No. 183 of 2019.
