The present case has been filed for proper investigation in connection with the first information report of Baisi P.S. Case No. 7 of 2020 registered under Sections 272 and 273 of the Indian Penal Code and 30(a), 41 and 47 of the Bihar Prohibition and Excise Act, 2016.

Counsel for the State submits that the petitioner is not named in the first information report.

In this view of the matter, liberty is granted to the petitioner that he shall represent to the Superintendent of Police, Purnea (respondent no. 4) in the light of the order passed by the

Patna High Court CR. WJC No.1593 of 2022(2) dt.04-04-2023 2/2 coordinate Bench in Cr.W.J.C. No. 153 of 2017 (Surendra Singh Vrs. State of Bihar & Ors.) and analogous cases decided on 09.09.2022 within four weeks from today and the Superintendent of Police shall consider the representation and take appropriate action.

With this observation, this criminal writ petition is disposed off.
