2. The petitioner is seeking regular bail in connection with Barahat P.S. Case No. 104 of 2024 for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

3. As per prosecution case, there has been recovery of 93.750 liters of illicit liquor from a tempo and this petitioner was apprehended on spot by the police.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has no concern with the alleged recovery of liquor and nothing has been recovered from his possession. A

Patna High Court CR. MISC. No.66610 of 2024(2) dt.26-09-2024 2/2 statement has been made in para-3 of the bail petition that the petitioner has clean antecedent. He is under custody since 09.05.2024.

5. On the other hand, learned APP for the State has opposed the prayer of bail of the petitioner.

Considering the above-mentioned facts and circumstances of the case as well as petitioner having clean antecedent, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge IInd CumSpecial Judge Excise Court-1, Banka in connection with Barahat P.S. Case No. 104 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
