====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-05-2023 Heard learned counsels for the petitioners and the State.

Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code and later on, Section 302 of the Indian Penal Code was added.

Prosecution case, in brief, is that on 14.05.2022 at about 08:00 AM, all the F.I.R. named accused persons including the petitioners came at the house of the informant and petitioner Nos. 1 and 2 caught father of the informant and on the order of No. 3, attacked father of the informant by means of iron katta on

Patna High Court CR. MISC. No.61963 of 2022(2) dt.01-05-2023 2/2 his head due to which he sustained injury and was admitted to hospital.

Learned counsel appearing for the petitioners submits specific allegation of assault is against other accused persons and so far these petitioners are concerned, allegation against them is general and omnibus. He further submits that on account of some quarrel between them, both the parties assaulted each other. Petitioners have got clean antecedent. Considering the aforesaid facts and circumstances, let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Bind P. S. Case No. 75 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
