The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The prosecution case is that the mother of the informant Shanti Devi was killed, when suspicion was raised by the informant against petitioner and others. The accused has intention to grab the landed property of the informant.

It is submitted by the learned counsel for the petitioner that the petitioner is the cousin brother of the informant and maliciously the suspicion has been raised. Admittedly, there is no eye witness to the occurrence. Statement has been made in para-3 of the petition that

Patna High Court Cr.Misc. No.39006 of 2015 (2) dt.01-10-2015 petitioner has no criminal antecedent. Similarly situated coaccused Hemant Kumar has been granted bail vide Cr. Misc. No. 23416 of 2015.

Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad P.S. Case No. 121 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
