====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-07-2017 Heard the learned counsel for the petitioners. The petitioners seek anticipatory bail in connection with Fatuha P.S. Case No. 133 of 2016, registered for the offence punishable under Sections 504, 505, 506 of the Indian Penal Code and 3/4 of the D.P. Act.
It is alleged in the written report that the engagement of the sister of the informant was solemnized with the brother of the petitioners on 26.01.2016 and the date of marriage was fixed for 22.04.2016, however, on account of demand of dowry by the accused persons, the marriage could not be performed. The learned counsel for the petitioners submits that the petitioners are the brothers of the proposed husband, the accused persons had returned the money, which they have received prior to the engagement and the petitioners have clean antecedent. The
Patna High Court Cr.Misc. No.32531 of 2017 (2) dt.13-07-2017 2/2 learned counsel for the petitioners also submits that similarly situated accused person has been granted anticipatory bail by this Court vide order dated 07.07.2017 passed in Cr. Misc. No. 26606 of 2017.
Having regard to the facts and circumstances of the case, particularly the parity of the case of the petitioners to that of the co-accused, who has been granted anticipatory bail by this Court, I deem it fit and proper to grant anticipatory bail to the petitioners.
Accordingly, in the event of their arrest or surrender in the Court below within a period of four weeks from today, let the above named petitioners be enlarged on bail on furnishing bailbonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned J.M., Patnacity, Patna, in connection with Fatuha P.S. Case No. 133 of 2016 subject to the conditions laid down under Section 438(2) Cr. P. C. (Mohit Kumar Shah, J) BTiwary/- U T
