JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-09-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 290 of the Indian Penal Code and 47(a) of the Excise Act.
The prosecution case is that the informant received information that the petitioner is selling country made liquor when the police reached near the hutment of the petitioner, the petitioner escaped from the scene but 52 plastic bottles of country made liquor each containing 400 ML total 20.8 liter were recovered. It is submitted by the learned counsel for the petitioner that there is nothing on record to suggest that the recovery has been made from the hutment of the petitioner.
