This is the second attempt of the petitioner for grant of regular bail in connection with Araria (Bairgachhi) P.S. Case No.28 of 2022 registered under Sections 8/20(b)(ii) (c)/25/29 of the N.D.P.S. Act. Earlier, the bail of the petitioner was rejected vide order dated 04.02.2023 passed in Cr. Misc. No. 50289 of 2022.

About 42.8 Kgs of ganja has been recovered from a vehicle in which the petitioner was found travelling. 4.

The petitioner is in custody since 30.06.2022 and he has clean antecedent. Co-accused namely, Pawan Kumar, has been granted bail by this Court vide order dated 01.12.2023 passed in Criminal Miscellaneous No.60215 of 2023. 5.

Considering the fact that similarly situated co-accused has been granted bail by this Court and also

Patna High Court CR. MISC. No.64980 of 2023(7) dt.13-03-2024 2/2 considering the period of custody of the petitioner, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, Araria, in connection with Araria (Bairgachhi) P.S. Case No.28 of 2022, subject to the condition that the petitioner shall co-operate in the trial and shall be properly represented on each and every date through his lawyer or himself fixed by the court below. In the event of failure to appear on two consecutive dates without sufficient reason, the court below will be at liberty to pass appropriate order including cancellation of bail bonds of the petitioner.
