The petitioner apprehends his arrest in connection with Sakra P.S. Case No.42 of 2022, registered for the offence punishable u/s 8/20/22 of N.D.P.S. Act and 25(1-b)a, 26/35 of the Arms Act.
As per prosecution case, police apprehended three persons and from their possession recovered one Kg Ganja and 315 'Desi Katta'. It is alleged that on seeing the police, other accused persons including the petitioner fled from the spot. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. The name of petitioner transpired in this case on the confessional statement of the
Patna High Court CR. MISC. No.63010 of 2022(3) dt.13-03-2023 2/2 apprehended co-accused. Petitioner has neither been apprehended on spot nor any recovery has been made from his conscious physical possession. Petitioner has no concern with the alleged recovered contraband articles or the arms or the apprehended co-accused. Petitioner has two criminal antecedent. Learned APP for the State opposed the prayer for bail. Having regard to the facts and circumstances of the case, considering that petitioner is the member of the syndicate, who is involved in trade of contraband articles and arms, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is rejected.
This application is accordingly dismissed.
