The petitioner apprehends his arrest in Hajipur Sadar P.S. Case No. 42/2013, registered for the offences punishable under Sections 385, 307 and other Sections of the Indian Penal Code.

The informant alleged that three persons intercepted him and demanded extortion. The informant identified this petitioner. The petitioner and other persons assaulted with sickle on his neck and other parts of his body.

It is submitted that the petitioner also filed a case bearing Hajipur Sadar P.S. Case No. 38/2013. Some dispute arose between the petitioner and the informant due to sitting arrangement in the school and that is why this false case has been

Patna High Court Cr.Misc. No.36895 of 2015 (3) dt.04-11-2015 2/2 filed.

It appears that the informant made very specific allegation that the petitioner along with others firstly demanded extortion and thereafter assaulted the informant with sickle on neck and other part of the body.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
