Petitioner seeks bail in a case registered for the offences punishable under Sections 30, 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.
Recovery of liquor is alleged from the house of coaccused Rajeshwar Prasad and allegation against the petitioner is that he is a business partner. Allegation is that two sons of Rajeshwar Prasad had brought the liquor from the house of this petitioner. Petitioner has got a long list of identical criminal antecedent.
Considering the facts aforesaid, let the petitioner, above named, be released on bail, if the trial of the case is not concluded within a period of six months from the date of framing of the charges, on furnishing bail bond of Rs.20,000/-
Patna High Court CR. MISC. No.58950 of 2019(2) dt.26-09-2019 2/2 (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Masarakh Police Station Case No. 194 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
