2. The petitioners have prayed for regular bail in a case instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Amendment Act 2018.

3 As per FIR, it is a case of assembly for commission of offence and accused persons along with the petitioner was apprehended on the spot. It is further alleged that from the possession of the petitioner, one cartridge was recovered.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. The petitioner is in custody since 26.04.2023. Petitioner has no criminal antecedent.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 12th Muzaffarpur, East, in connection with Sakra P.S. case No. 193 of 2023.
