JUSTICE SANJAY PRIYA ORAL ORDER 11-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Galgalia P.S. Case No. 24 of 2017 instituted for the offence under Sections 380, 461 and 34 of the Indian Penal Code.

It is alleged in the written report that Rs.30,000/- has been stolen from the shop of the informant. The informant also found the lock of sweet shop of Rambabu Gupta broken. It has been submitted on behalf of the petitioner that he has merely been arrested on suspicion as he has purchased LD.T.V for Rs.9,000/- on 28.3.2017. It has further been submitted that there is no identification mark expressed by the informant to suggest that petitioner has stolen money of the informant. The petitioner is said to be in custody since 31.3.2017.

Patna High Court Cr.Misc. No.31299 of 2017 (2) dt.11-07-2017 2/2 It is mentioned in paragraph-3 of the bail petition that petitioner has no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj, in connection with Galgalia P.S. Case No. 24 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
