JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-09-2025 Heard Mr. Sudhanshu Prakash, learned counsel appearing on behalf of the petitioner and Mr. Parmanand Prasad, learned APP appearing on behalf of the State.

The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 147, 148, 149, 307, 427, 353, 435, 283, 120B and 121A of the Indian Penal Code, Section 27 of the Arms Act, Section 3 of the Damage to Public Property Act, Section 17 of the C.L.A. Act and Sections 10 and 13 of the U.A.P. Act.

3. As per prosecution case, all the F.I.R. named accused persons, including this petitioner, in connivance with other extremist organizations, called for a Bihar and Jharkhand Band (strike). It is alleged that during the Band, the group blocked G.T. road, burnt vehicles and damaged the road. It is

Patna High Court CR. MISC. No.64331 of 2025(2) dt.16-09-2025 2/3 further alleged that when informant along with other police personnel went at the spot, all the accused persons started firing and fled away from the place of occurrence.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. As per F.I.R., 26 named, including this petitioner and 250 to 300 unidentified people are alleged to have participated in the alleged incident. Allegations are general and omnibus and no specific accusation of overt act has been alleged against this petitioner. It is further submitted that petitioner had no prior knowledge of his implication in the present case. It was only when he moved for grant of anticipatory bail in connection with Dumariya P.S. Case No. 55 of 2018 and a report with regard to criminal antecedents of the petitioner was called for from the Superintendent of Police, Gaya, he became aware of his implication in the present case.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the facts and circumstances of the case and general and omnibus nature of accusation, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-1st, Sherghati, Gaya in connection with Amas P.S. Case No. 88 of 2015, subject to condition as laid down under Section 482(2) of the B.N.S.S..
