JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-06-2016 Heard learned counsels for the petitioner and the State. The petitioners being the father, brother and sister of the husband of the informant are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 498A and 506/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The basic accusation is of torture for non-fulfillment of the dowry demand and causing burn injury.
It is submitted by learned counsel for the petitioner that the accusation is omnibus and general against the petitioners. Thrust of accusation is against the husband of the informant. On conclusion of investigation, the petitioners were not sent up for trial and final form was submitted but differing with the final form cognizance has been taken against the petitioners also.

No.25697 of 2016 (2) dt.22-06-2016 2/2 Considering the fact that on conclusion of investigation, petitioners were not sent up for trial, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Araria in connection with Sikty P.S. Case No. 102 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
