2. The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 323, 307, 34 of the Indian Penal Code.

3. As per the prosecution case, on 12.05.2024 at about 10 AM, all the F.I.R. named accused persons including these petitioners assaulted younger brother of informant and when informant went to save his brother, petitioner no. 1 assaulted on his head with iron rod and thereafter, other co-accused persons also assaulted informant and his brother.

4. Learned counsel for the petitioners submits that due

Patna High Court CR. MISC. No.68377 of 2024(2) dt.23-10-2024 2/2 to petty dispute, scuffle took place between the parties, in which both sides sustained injury. He further submits that there is delay of 22 days in lodging this case and there is no plausible explanation of delay. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Simri Bakhtiarpur P.S. Case No. 263 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
