====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 13-07-2017 Heard Sri Akhauri Kamal Kishore Sahay, learned counsel for the petitioners.

The petitioners apprehend their arrest in connection with Paliganj P.S. Case No. 19/2017 registered under Sections 452, 454, 341, 323, 307, 380, 504 read with Section 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that so far as the present petitioners are concerned there is no specific allegation of assault against these two petitioners. He would further submit that although the petitioners are named in the F.I.R., however, a bare reading of the same would show that the dispute has arisen out of some mining activities. He would further submit that in fact one of the co-accused, namely, Ravi Shankar Sharma, against whom there is a specific allegation of assault from

Patna High Court Cr.Misc. No.31730 of 2017 (2) dt.13-07-2017 2/2 the butt of a pistol upon the head of the informant, has been granted privilege of anticipatory bail by a co-ordinate bench of this Court. The petitioners have no criminal antecedents and are ready to cooperate in the investigation.

No one appears for the State.

In the facts and circumstances, let the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, be enlarged on anticipatory bail on their furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Danapur, Patna in connection with Paliganj P.S. Case No. 19/17, subject to the conditions as laid down under Section 438(2) Cr.P.C. The petitioners shall immediately join the investigation and shall report to the Investigating Officer within a week.

The application stands disposed of.
