1. Heard learned counsel for the petitioner, Ms. Sushmita Sharma and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 86 and 3(5) of the BNS, 2023 and later Section 69 of BNS has been added.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that petitioner, on pretext of marriage, was establishing physical relation for the last two years, further petitioner qualified in TRE-3 exam and thereafter started demanding dowry of Rs. 8 Lakhs when informant showed her inability to pay the amount, the petitioner refused to marry, it is next alleged

No.62811 of 2025(2) dt.02-09-2025 2/3 that the informant went to the house of the petitioner for complaining when she was assaulted by the mother and elder brother of the petitioner, further mother of the petitioner dragged her inside the house and elder brother tried to commit rape and threatened before the villagers that he will kill her by poisoning or by tying up with a fan.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the F.I.R., it would manifest that the informant alleges that petitioner established physical relation on pretext of marriage, it is next submitted that both petitioner and the informant are adults and the relationship was consensual. It is further submitted that petitioner subsequently came to know that informant was already married to one Manmohan Kumar resident of village Tulsiyahi on 26.02.2025, as such, the relationship soured but when petitioner qualified in the TRE-3 examination, thereafter the instant FIR came to be instituted. It is also submitted that from perusal of the allegation as alleged in the F.I.R., it would manifest that informant has tried to malign the entire family members by alleging that mother of the petitioner dragged her inside the house and elder brother of the

Patna High Court CR. MISC. No.62811 of 2025(2) dt.02-09-2025 3/3 petitioner tried to commit rape. It is also submitted that the FIR came to be instituted on 04.06.2025 after the petitioner had given his joining as teacher on 15.05.2025.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Pupri P.S. Case No. 186 of 2025 subject to the conditions as laid down under Section 482 (2) of BNSS.

7. Accordingly, the instant anticipatory bail application stands allowed.
