The petitioner seeks bail in a case instituted for the offences under Sections 447, 307/34 of the Indian Penal Code, 27 of the Arms Act and 3⁄4 of Explosive Substance Act. The earlier bail application of the petitioner was rejected vide Annexure-1 to the present application with a direction to the Trial Court to conclude the trial at the earliest. A report has been called for from the Court below. It has been reported that charge has been framed on 30.08.2019 and since then no prosecution witnesses have been examined in the present case.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.11.2018. There is no

Patna High Court CR. MISC. No.64193 of 2019(3) dt.19-02-2020 2/2 allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. There is no likelihood of trial being concluded in near future. The petitioner has falsely been implicated in the present case due to previous enmity.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-XVI-cum- Additional Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P.S. Case No. 225 of 2017.
