JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-07-2017 This application is for grant of regular bail in connection with Phulwaria P.S. Case No. 34 of 2017 registered for the offence(s) under section(s) 395 of the Indian Penal Code. The petitioner is not named in the FIR, however it appears that his name transpired during investigation on the confessional statement.

Submission of the learned counsel for the petitioner is that except confessional statement, there is nothing against the petitioner. There is no recovery from the possession of the petitioner and he was not put on TIP. So far allegation is concerned, in one case he has been arrested and remanded. He is in custody for one and half months.

Heard learned Additional Public Prosecutor also.

No.31520 of 2017 (2) dt.13-07-2017 2/2 Having heard both sides and in view of the fact that the charge sheet has not been submitted in this case, in such view of the matter, this application is disposed of with a direction to the Court below that once the charge sheet is being submitted in this case, he will examine the materials available on record and if there is nothing against the petitioner except confessional statement, he will release the petitioner on furnishing bail bond of Rs. 25,000/- (Rs. Twenty five thousand) with two sureties of the like amount each to his own satisfaction in connection with Phulwaria P.S. Case No. 34 of 2017, otherwise he will report the matter to this Court.
