====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-09-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Arer P.S. Case No. 16 of 2019, registered under Sections 341, 323, 353 and 504/34 of the Indian Penal Code. The accusation is that on receiving information about blocking the road near Ward No. 12, at village Dhakjari, the informant being the Circle Officer along with police personnel reached there then saw 50 to 60, men and women, having Danda, stick and bamboo blocked the road. When informant made query, they replied that due to non construction of road, they blocked the road saying that on the instruction of Md. Sabir and Binay Kumar Jha (petitioner), they blocked the
Patna High Court CR. MISC. No.58280 of 2019(2) dt.16-09-2019 2/2 road. Thereafter, they disturbed the law and order and hampered the Government work.
Learned counsel for the petitioner submits that the name of the petitioner was not identified in involving of blocking of the road rather his name was disclosed by the persons, who were present there and involving in road block. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Benipatti, Madhubani, in connection with Arer P.S. Case No. 16 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
