JUSTICE JYOTI SARAN ORAL ORDER 30-03-2016 This application has been filed alleging noncompliance of the order passed by this Court in CWJC No.13538 of 2014 whereby the petitioner was directed to raise his grievance regarding non-payment of dearness allowance, travelling allowance etc. which, according to the petitioner, was to the tune of Rs.47,255.28 before the Block Development Officer, Akodhigola, district- Rohtas and who was directed to dispose of the same after opportunity of hearing to the petitioner. The representation filed by the petitioner is placed in the contempt application and which merely raises claim of Rs.47,255.28 stated to be towards the arrears of salary, travelling allowance and dearness allowance but the same is absolutely

A show cause has been filed by the Block Development Officer and the District Panchayati Raj Officer in which it is stated that a cheque bearing no.641675 dated 3.7.2012 amounting to Rs.47,257/- was given by the Block Development Officer to the newly elected Sarpanch, namely, Ram Krishna Chaudhary who has made payment of Rs.2145/- to the petitioner which includes all the allowances. The petitioner disputes this payment and submits that he is entitled to further payment.

Be that as it may, considering that the representation so filed by the petitioner in the light of the order passed in CWJC No.13538 of 2014 is non-descriptive, no contempt is made out as against the opposite parties in the manner of its disposal and this application is disposed of with a liberty to the petitioner to file a detailed representation raising his claim and it goes without saying that any such claim raised with supportive document would be disposed of by the Block Development Officer, Akodhigola in the light of the direction passed in CWJC No.13538 of 2014 .
