This is an application for bail in connection with Mithanpura P.S. Case No. 95 of 2017 registered for the offences punishable under Sections 302, 120B and 34 of the Indian Penal Code.

Allegation against the petitioner is of demanding extortion from the informant while he is purchasing a house. However, petitioner is not named in the FIR and later on his name transpires in confessional statement of co-accused. Submission of learned counsel for the petitioner is that except confessional statement there is nothing against him and he has falsely been implicated in this case. Further submission is that petitioner has been made accused in five other cases but those cases are old and at that time petitioner was Mukhiya and he is in custody for about five months.

Heard learned APP also, who has opposed the prayer for

Having heard both sides and in view of facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, East Muzaffarpur, in connection with Mithanpura P.S. Case No. 95 of 2017, subject to the following conditions :- (1) One of the bailors shall either be a public representative or Government Official having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will mark his attendance in the local police station in first week of every month till conclusion of trial, failing which prosecution will be at liberty to move cancellation of his bail bond.
